By accessing or using Eggcellent (the "Service"), including our web application and Chrome browser extension, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Eggcellent. We reserve the right to update these Terms at any time. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

2. Description of Service

Eggcellent is an AI-powered service that:

• Extracts recipes from cooking videos on supported platforms (currently YouTube)
• Uses artificial intelligence to transcribe and structure recipe information
• Allows you to save, organize, and manage recipes in your personal cookbook
• Provides shopping list functionality
• Offers subscription plans with varying usage limits

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. User Accounts and Eligibility

To use the Service, you must:

• Be at least 13 years of age
• Create an account with accurate information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or cancel subscriptions at our sole discretion.

4. User Responsibilities and Prohibited Uses

• Upload or transmit viruses, malware, or malicious code

5. Subscription Plans and Billing

• Subscriptions automatically renew at the end of each billing cycle
• You authorize us to charge your payment method for recurring subscription fees

• Failed payments may result in service suspension or account termination

5.3 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge all fees. We do not store your full credit card information.

5.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period. You will retain access to paid features until the end of your current billing period. No refunds will be provided for partial periods except as stated in our Refund Policy.

6. Intellectual Property

6.1 Service Ownership

The Service, including all content, features, and functionality, is owned by Eggcellent and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

6.2 User Content and AI-Generated Recipes

You retain ownership of recipes you create or modify in the Service. AI-generated recipe extractions are provided to you for your personal use. Original video content remains the property of the respective content creators. You are responsible for respecting the intellectual property rights of video creators when using extracted recipes.

6.3 Trademarks

"Eggcellent" and associated logos are trademarks of Eggcellent. You may not use our trademarks without prior written consent.

The Service allows you to access content from third-party platforms (YouTube, TikTok, Instagram, X). We do not control, endorse, or assume responsibility for third-party content. 9. Disclaimers and Limitations of Liability

9.1 Service Availability

We do not guarantee that the Service will be available at all times or that it will be error-free. We may experience downtime, interruptions, or technical issues. We are not liable for any service disruptions or data loss.

9.2 "AS IS" Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EGGCELLENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Eggcellent and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your violation of any third-party rights, including intellectual property rights
• Any content you submit, post, or transmit through the Service

11. Account Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms or our policies
• Is harmful to other users, third parties, or our business interests
• Exposes us to legal liability
• Is fraudulent or involves non-payment of fees

Upon termination, your right to use the Service will immediately cease. You may delete your account at any time from your account settings. Termination does not relieve you of any obligations incurred prior to termination.

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, you agree to first contact us to attempt to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue legal remedies.

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of material changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Service after any changes become effective constitutes your acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Eggcellent regarding the use of the Service and supersede all prior agreements and understandings.
